USCIS Announces Enhanced Integrity Measures for the H-1B Program

The United States Citizenship and Immigration Services (USCIS) has announced a final rule to strengthen integrity and reduce the risk of fraud in the H-1B registration process. This rule aims to ensure that each beneficiary has equal opportunities in selection, regardless of the number of registrations filed on their behalf.

Additionally, USCIS has established the dates for the initial H-1B registration period for fiscal year 2025 and has launched online filing for forms related to H-1B petitions.
The final rule introduces a new beneficiary-centric process, where registrations will be selected on a per-beneficiary basis rather than per registration, thereby reducing the potential for fraud. Starting from the initial registration period for fiscal year 2025, USCIS will require valid passport or travel document information for each beneficiary, aiming to bolster process integrity. Furthermore, the final rule codifies USCIS’s ability to deny or revoke H-1B petitions based on registrations with false or invalid statements.
It also authorizes USCIS to deny or revoke approval of an H-1B petition if the fee associated with the registration has been rejected or deemed invalid after submission. These measures aim to enhance equity, efficiency, and integrity in the H-1B process, from registration to final decision and submission of approved petitions to the Department of State.
