U.S. Border Patrol must take charge of migrant children waiting in camps. Migrant children awaiting processing by the Border Patrol in makeshift camps along the Mexico-U.S. border are under the custody of that agency and are subject to an old agreement, overseen by courts, that sets rules for their treatment, a judge ruled.
The issue of when children are officially under the custody of the Border Patrol is particularly important because of the 1997 court agreement on how migrant children under the custody of the U.S. government should be treated.

These rules include a time limit for the detention of minors and the provision of services such as toilets, sinks, and temperature checks.
The decision means that the Department of Homeland Security must quickly process the children and place them in “safe and hygienic” facilities.
The border camps have become a flashpoint between migrant advocates and the federal government. The United States has said that smugglers send migrants to the camps and have argued that children are not yet under the custody of the Border Patrol because they have not been arrested.
Advocates say that the U.S. government is responsible for the children and that the Border Patrol often drives migrants to the camps, sometimes transporting them in vehicles.
Children traveling alone must be handed over to the Department of Health and Human Services within 72 hours. Generally, that agency releases them to relatives in the United States while an immigration judge considers the possibility of granting them asylum. Families seeking asylum are usually released in the United States while their cases go through the courts.
