    Temporary agricultural workers in the U.S. will have more protections against retaliation and other abuses

    The U.S. Department of Labor issued rules offering greater protection to temporary workers, benefiting more than 300,000 individuals engaged in agricultural work.

    Temporary agricultural workers will have more legal protections against employer retaliation, unsafe working conditions, illegal hiring practices, and other abuses, according to a rule from the Department of Labor announced this Friday.

    Every year, about 300,000 immigrants, mainly Mexicans, perform seasonal jobs on American farms. The new rule, which will take effect on June 28, will address the abuses experienced by those working in the H-2A program, undermining fair labor standards for all agricultural workers.

    “Far too often, H-2A program workers face abusive working conditions that harm all U.S. agricultural workers,” said Acting Labor Secretary Julie Su. “This rule ensures that H-2A program workers receive fair treatment, have a voice in their workplace, and can perform their duties safely.”

    President Joe Biden’s administration announced a proposal for the new rule in September, stating that it would enhance farm safety requirements and increase transparency on how these workers are hired to combat human trafficking.

    The Department of Labor is mandated to ensure that the H-2A program does not adversely affect the wages or working conditions of Americans doing similar jobs. Employers are required to pay at least the U.S. minimum wage or more, depending on the region. They must also provide housing and meals for their temporary workers.
