    USCIS Releases New Guidance on Eligibility Criteria for the EB-1 Visa for Individuals with Extraordinary Ability

    The United States Citizenship and Immigration Services (USCIS) has released new guidance in its Policy Manual to clarify the eligibility criteria for EB-1 visa classifications for individuals with extraordinary ability (E11).

    This update provides greater clarity on the types of evidence considered for determining the eligibility of EB-1 visa applicants and addresses several key points:

    Team Awards: It confirms that individual recognition within a team context will be considered, as long as the award is of national or international recognition for excellence in the field of endeavor.

    Past Memberships: It is now clarified that previous memberships can be considered under the “membership” criterion.

    Published Material: The previous language suggesting that published material needed to demonstrate the value of the applicant’s work and contributions to meet this criterion has been removed.

    Exhibitions: It explains that while the dictionary defines “exhibition” as a public display, only artistic exhibitions will be valid under this criterion. Non-artistic exhibitions will only be considered if supported by comparable evidence.

    This update is part of an effort to provide more transparency and streamline the evaluation process for EB-1 visa applicants. The new guidance takes effect immediately and replaces any previous guidance related to these criteria.
