    U.S. Appeals Court Rejects Biden’s DACA Program

    The United States 5th Circuit Court of Appeals has recently rejected the regulation implemented by President Joe Biden’s administration aimed at strengthening the Deferred Action for Childhood Arrivals (DACA) program. This ruling comes just days before President-elect Donald Trump takes office.

    Judicial Decision and Scope

    The court upheld a prior 2023 ruling that determined Biden’s proposed regulation failed to address the program’s legal deficiencies. However, the decision is limited to the state of Texas, meaning its immediate impact may not extend to other states.

    Despite the rejection, the court left in place an injunction that allows current DACA recipients to maintain their status while litigation continues.

    Impact of the DACA Program

    DACA has provided deportation relief and work permits to approximately 537,000 individuals who arrived in the United States irregularly as children. According to the U.S. Citizenship and Immigration Services (USCIS), most recipients are from Mexico, followed by countries like El Salvador, Guatemala, and Honduras.

    Trump Administration’s Position

    President-elect Donald Trump has announced plans to tighten immigration policies after taking office, including the deportation of undocumented immigrants. However, in recent statements, he has expressed a willingness to negotiate a solution with Democrats for the so-called “Dreamers.”

    Legal Challenges and Reactions

    Biden’s 2022 regulation sought to strengthen the legal foundation of DACA but faced opposition from Texas and other states led by Republican attorneys general. They argued that the program imposes additional costs on states for healthcare and education.

    Meanwhile, immigrant advocacy groups emphasize that DACA recipients have positively contributed to the U.S. economy and society, noting that they came to the country as minors through no fault of their own.

    Current Status and Outlook

    With the new administration taking office and the possibility of new measures, DACA’s future remains uncertain. The situation is expected to spark further debates at both legislative and judicial levels in the coming months.
