
Trump Seeks End to TPS for Venezuelans: Case Reaches Supreme Court
On May 1, 2025, President Donald Trump’s administration filed an appeal with the U.S. Supreme Court seeking to end deportation protections known as Temporary Protected Status (TPS) for more than 300,000 Venezuelan nationals. The measure follows a prior decision by Secretary of Homeland Security Kristi Noem to cancel the humanitarian relief.

TPS is a program that grants temporary permits to live and work in the U.S. to nationals of countries affected by armed conflict, natural disasters, or other extraordinary conditions. In this case, the removal of protections was challenged by a group of Venezuelans who argued that the move violated the Administrative Procedure Act by failing to follow proper policy change procedures. They also pointed to possible racial and political motivations behind the decision.
In March, a federal district court in California temporarily blocked the measure from taking effect. The Ninth Circuit Court of Appeals later rejected the Trump administration’s attempt to overturn that ruling in April. In response, the government filed an emergency appeal to the Supreme Court, arguing that the lower court’s order limits key executive powers over immigration policy—an area that, according to the administration, requires flexibility and swift action.
This case is one of eleven emergency matters from Trump’s second term currently under review by the high court. Other pending issues include appeals related to the dismissal of members of independent agencies, restrictions on transgender individuals in military service, and deportations under the Alien Enemies Act.
