    DOL Firewall Project: Protecting the Highly Skilled U.S. Workforce

    The U.S. Department of Labor (DOL) launched the Firewall Project, an enforcement initiative focused on monitoring the use of H-1B visas to ensure that employers prioritize qualified American workers and comply with existing regulations.

    Key Points of the Firewall Project

    • The DOL may initiate investigations certified by the Secretary of Labor when there are reasonable grounds for noncompliance in the H-1B program.
    • Investigations could lead to penalties, payment of back wages, and temporary bans on using the H-1B program.
    • The DOL will work with federal agencies such as USCIS, the Department of Justice, and the EEOC to coordinate actions and share information on program abuse.
    • DOL offices, especially the Wage and Hour Division, will provide compliance resources for employers who want to operate legitimately.

    Why Is It Important?

    • Reinforces the requirement that employers must demonstrate they tried to hire U.S. citizens or residents before turning to H-1B visas.
    • Increases risks for employers who fail to comply with regulations, which could discourage abusive practices.
    • For H-1B workers, it may mean greater oversight of working conditions, wages, and compliance with requirements.

    • Stay well informed about your rights and obligations under an H-1B visa.
    • Request clear employment and payment documentation to demonstrate contract compliance.
    • Seek legal or expert advice if you believe your employer is acting improperly.
    • Report violations to the DOL or relevant entities if you identify trafficking, discrimination, or abuse.
