
DHS ends automatic extensions of work permits: focus on security and background verification
The Department of Homeland Security (DHS) announced a new rule that changes the way Employment Authorization Documents (EAD) are renewed. Starting October 30, 2025, foreign nationals applying for the renewal of their work permit will no longer receive an automatic extension while their application is pending.
There are limited exceptions to this rule, including extensions provided by law or through a Federal Register notice for employment documentation related to Temporary Protected Status.

This measure seeks to strengthen national and public security by prioritizing a more thorough background and security check review before approving any employment extension. According to DHS, conducting more frequent evaluations will allow U.S. Citizenship and Immigration Services (USCIS) to prevent fraud and detect potential risks to the country.
USCIS Director Joseph Edlow stated that the goal is to ensure that “background checks and security investigations are properly completed before extending work authorization.” He also reminded that “working in the United States is a privilege, not a right.”
USCIS recommends that applicants file their renewals up to 180 days before the expiration of their current permit to avoid interruptions in their work authorization. Important: this new provision does not affect EADs that have already received an automatic extension before October 30, 2025.
