
USCIS increases Premium Processing fees starting March 2026
USCIS announced increases in Premium Processing fees due to inflation. The new fees apply starting March 1, 2026.
The United States Department of Homeland Security (DHS) published a final rule increasing USCIS Premium Processing service fees, with the goal of reflecting accumulated inflation between June 2023 and June 2025, pursuant to the authority granted by the USCIS Stabilization Act. This adjustment seeks to preserve the real value of expedited processing and strengthen the agency’s adjudication processes.

Starting March 1, 2026, Premium Processing fees increase across several immigration filings. For Form I-129 in classifications such as H-1B, E-1, E-2, E-3, L-1, O-1, and P, the fee increases from $2,805 to $2,965. In the H-2B and R-1 categories, the cost rises from $1,685 to $1,780. Form I-140 in employment-based classifications (including EB-1, EB-2 with and without NIW, and EB-3) also increases from $2,805 to $2,965. For Form I-539 (F, J, and M status), the fee increases from $1,965 to $2,075, and for certain Form I-765 filings related to OPT and STEM-OPT, the cost increases from $1,685 to $1,780.
USCIS reported that the revenue generated by this increase will be used to fund the Premium Processing service, improve adjudication processes, and address backlogs in pending cases. Any Premium Processing request filed on or after March 1, 2026 must include the new applicable fee using Form I-907; otherwise, it may be rejected.
