
The United States implements a new $5,000 immigration fee for noncitizens apprehended without authorization
The U.S. Department of Homeland Security published an official notice in the Federal Register establishing new fees related to the enforcement of immigration laws, as provided under the One Big Beautiful Bill Act (HR-1). According to this notice, foreign individuals who are apprehended between ports of entry and deemed inadmissible under immigration laws must pay an immigration fee of $5,000 for fiscal year 2025 for the corresponding enforcement service.

The HR-1 law, enacted in July 2025, authorized the Department of Homeland Security to establish these fees as part of a series of new financial obligations that noncitizens must pay under certain immigration enforcement circumstances. In the specific case of the apprehension fee, it applies to those who are detained for not being legally admitted into the United States when entering outside of official ports of entry, which by law classifies them as “inadmissible.”
The adjustment notice published details that this fee, along with other similar fees, is subject to annual inflation adjustments. For fiscal year 2026, the adjusted amount of the fee will be $5,130, and it will be charged by the corresponding authorities upon the apprehension of the noncitizen.
Although the fee is mandatory according to the text of the law, the Department of Homeland Security will individually notify the affected individuals and provide instructions on how to make the payment. The fees established under HR-1 are designed to cover the costs of immigration law enforcement and do not replace other penalties or fines for immigration violations.
